Lamu politician cry foul over eviction from his property

A Lamu politician has written a protest letter to the Regional Criminal Investigation Officer Coast region over a forceful eviction carried out at his property using goons.

It was against a court of appeal ruling.

Mohammed Madhubuti, who copied the signed letter to the Independent Policing Oversight Authority (IPOA), accused the Officer Commanding Station (OCS) in charge of Makupa police station for allegedly supervising the breaking into his property.

He accused the local OCS, his officers and investigation officers of forcefully evicting him from his own property.

“The OCS supervised the breaking into my property using hired goons,” he said.

Madhubuti regretted the breaking into his property was carried out contrary to a court of appeal ruling involving the business property along Lumumba Road in Mvita consistency, Mombasa county.

Madhubuti, who is a KANU activist, said in his complaint that he had reported the case of people invading his property but the authorities ignored him.

He added that he had written various notices to the occupants of the property to vacate but the notices were also ignored.

“Last week the local OCS led a contingent of police officers in an operation to evict me from the property and forcibly detained me,” he added.

The politician called for investigations into the conduct of the OCS.

Court

The Court of Appeal sitting in Mombasa, which comprised of Judge Kairu, Lady Justice Pauline Nyamweya and Judge Justice Jessie Lesiit ordered all subsequent transfers and entries to restore the title of the property to the company.

The suit over the property had put Standard Chartered Bank into an unfamiliar territory after it emerged that Lamu Marine and Allied Product Limited had allegedly fraudulently and illegally amended the company articles of association of the majority shareholders.

The Bank had to move to the court of appeal to challenge the judgment delivered by Environment and Lands Court over the ownership dispute of the property.

The court of appeal had declared that the resolution to amend the company’s memorandum and articles of association to add a clause 11A was illegal, fraudulent and null and void and set it aside.
